The following terms and conditions are binding for all 2nd Skin Tattoo & Piercing stores, including all partner companies

1. PREAMBLE

Our aim is to make your stay in our studios as pleasant as possible. We want you to be completely satisfied with the services provided by 2nd Skin.

If you have any complaints, please contact us directly. We will then take the opportunity to resolve your complaint to your complete satisfaction.

Although we want to make our business relationship with you as pleasant and uncomplicated as possible, we must regulate certain framework conditions in a legally binding manner.

You will therefore find our general terms and conditions here.

2. SUBJECT MATTER OF THE GENERAL TERMS AND CONDITIONS

The subject of the General Terms and Conditions is the regulation of the contractual conditions for all contracts concluded by 2nd Skin Tattoo & Piercing (including all partner companies and franchisees), hereinafter referred to as "2nd Skin", with the user, hereinafter referred to as "customer". The General Terms and Conditions of 2nd Skin Tattoo & Piercing shall apply in the version valid at the time the contract is concluded.

3. CONCLUSION OF CONTRACT
Offers from 2nd Skin are non-binding. A contract for the production of a tattoo/piercing is concluded when the customer commissions the design for the tattoo and/or agrees an appointment. The order is proven by the payment of a deposit by the customer. By placing a bid, the customer enters into a legally binding purchase contract. The bid also includes the possibility of minor deviations, typing errors and technical changes to our illustrations and descriptions. In this case, the contract may not be rescinded or contested.

2nd Skin reserves the right to reject an order. Claims of any kind arising from this rejection are expressly excluded by 2nd Skin.

The customer agrees to the General Terms and Conditions upon conclusion of the contract and furthermore waives the right to assert claims for damages or other costs of any kind against the tattoo studio and the tattoo artist/piercer in the event of complications.

4. INFORMATION OBLIGATIONS

The customer is obliged to provide truthful information when making the appointment or concluding the contract. If the customer fails to provide this information or provides false data, in particular false names and telephone numbers, 2nd Skin may withdraw from the contract if a contract has been concluded. 2nd Skin cannot be held liable for any consequences resulting from incorrect information provided by the customer. Customer data will not be passed on to third parties. 2nd Skin may use customer data for the purpose of important customer information and special offers.

5. PRICES AND TERMS OF PAYMENT

Appointments made by phone, e-mail or in person at one of our studios are binding.

The prices quoted at the time of order placement/contract apply to the sessions. The prices include reworking within the specified time frame, provided no other written agreements have been made and none of our maintenance instructions have been violated by the customer.

The monetary amount, as well as the deposit, are due immediately and payable without deduction, unless otherwise agreed in writing.

The customer shall pay a deposit due immediately upon booking the appointment in accordance with the agreement.

At the end of the appointment (session), the remainder of the predetermined price is due. The deposit will be charged or deducted at the last session.

Gift vouchers can be purchased in any amount and can only be redeemed in the studio where the voucher was purchased. The vouchers are not paid out, but are only valid for offsetting an order.
Each voucher is valid for a maximum of 1 year.

All prices are in Swiss francs.

6. RIGHT OF REVOCATION OF THE CUSTOMER

The client must cancel or reschedule the session no later than 2 working days (48 working hours) before the start of the session. In this case, the deposit will be refunded or maintained to the client in the form of a voucher for 2nd Skin's services for the value of the deposit. However, if this deadline is not met and the customer cancels less than 2 working days before the start, the deposit will be retained in full. 2nd Skin reserves the right to retain any advance payments made, especially if drawings have already been made for the customer. All cancellations must be made in writing to contact@2ndskn.com.

7. CONDITIONS

Tattoos/piercings are applied/inserted following the usual precautions and using high-quality materials.

Before we carry out a procedure in one of our studios, you will confirm truthfully in a declaration of consent that:

  • We have informed you about the process.
  • you have not withheld any disease (e.g. HIV, TB, hepatitis etc.) from us.
  • you are not suffering from any other infectious disease.
  • you are not under the influence of alcohol or drugs.
  • You are of legal age (otherwise the provisions under point 8 apply).
  • you have been informed about the care.
  • You as Female are not pregnant.
  • You assign the rights to the photos of the tattoo/piercing and any drawings to 2nd Skin and allow 2nd Skin to publish them on the Internet and in the studio.
  • you accept our general terms and conditions.

In principle, only ethically and morally acceptable slogans or motifs are tattooed. Furthermore, we reserve the right to reject motifs that we cannot stand behind.

8. PERSONS UNDER THE AGE OF 18

Persons under the age of 16 are not tattooed.

Persons under the age of 18 will only be tattooed if they are at least 16 years old, one of their legal guardians is present and both the customer and their legal guardian can present a valid ID.

Persons under the age of 12 are not pierced. Children from 6 months can have their ears pierced.

Persons under the age of 16 will only be pierced if they are at least 14 years old, one of their legal guardians is present and both the customer and their legal guardian can present a valid ID.

Persons between the age of 16 and 18 will only be pierced if they can present a valid ID and we have contacted one of their legal guardians by telephone.

9. COPYRIGHTS

The copyright of this website is owned by 2nd Skin.

2nd Skin does not check whether the copyrights of the customer's photo templates are owned by the customer. The customer assures 2nd Skin that he owns the rights to this template and indemnifies 2nd Skin against all claims arising from any infringement of rights or other violations of applicable law or copyright.

Unauthorized use, reproduction, distribution, publication or commercial use of the content on this website without the permission of 2nd Skin is prohibited and will be prosecuted under both criminal and civil law.

10. DATA PROTECTION

2nd Skin only collects data from the customer that is necessary for the execution of the session and contract processing without the customer's consent. 2nd Skin uses the data provided by the customer only for the purposes to which the user has consented. All information from 2nd Skin about customers can be turned off at any time.

11. HYGIENE

It goes without saying that we work strictly in accordance with hygiene regulations. We also provide detailed information (verbally and in writing) about care instructions and aftercare for tattoos and piercings. We assume no liability in the event of non-compliance. Our studios are regularly inspected by various authorities for hygiene.

12. EXCLUSION OF LIABILITY

2nd Skin is not liable for tattoos and piercings unless there is evidence of negligence. Worn and used jewelry cannot be exchanged for hygienic reasons. Any violation of physical integrity entails a health risk. By placing an order, the customer automatically consents to bodily injury and bears responsibility for this. To the best of its knowledge and belief, 2nd Skin minimizes the risk of errors and inflammation as much as possible. Aftercare and care is the responsibility of the customer. Instructions and guidelines for this are provided by 2nd Skin and the customer undertakes to follow them.

2nd Skin is not responsible for the loss or destruction of personal belongings and property of the customer brought into the tattoo studio.

No liability can be accepted for the accuracy, completeness or topicality of the content presented on this website. Furthermore, no liability is assumed for damages that may arise from the use of this website.

Despite careful control of the content, we assume no liability for the content of external links. The operators of the linked pages are solely responsible for their content.

We hereby expressly distance ourselves from all contents of all linked pages on our homepage and do not adopt these contents as our own. This declaration applies to all links on this website.

13. NOTE TO OUR CUSTOMERS

The majority of all tattoo artists in our studios (with the exception of interns) work as freelancers at their own expense/invoice and at their own risk. In the event of any problems, the artists are solely liable. 2nd Skin rejects any responsibility and warranty in connection with the tattooing work and refers customers for any liability claims directly to the respective artist.

14. JURISDICTION

The place of jurisdiction is Zurich. Applicable law is subject to Swiss law.

15. FINAL PROVISION

2nd Skin reserves the right to change the GTC at any time. When a contract is concluded, the GTC in the version valid at that time shall apply exclusively.

If a clause of these terms and conditions is invalid, the other clauses and the contract itself remain valid. Insofar as these clauses have not become part of the contract, the content of the contract shall be governed by the statutory provisions.
